Information about conditions of carriage

The provisions below shall apply to any transportation or carriage of passengers and baggage by a ship belonging to or chartered by Arctic Umiaq Line A/S.

§ 1 Arctic Umiaq Line is at liberty to honour the transportation agreement with a vessel other than that agreed or stipulated by the passenger. Arctic Umiaq Line reserves the right to accommodate the passenger in a category other than the one booked for the whole or part of the journey, and as compensation for such will pay only the pro rata difference between the price of the category booked and the lower category to which the passenger has been assigned.

§ 2 Arctic Umiaq Line is not responsible for irregularities in operations and reserves the right to make changes to the timetable and ticket prices without warning.
   Subs. 2. Lost or outdated tickets will not be replaced/refunded.
             Subs. 3. Provided that tickets for Arctic Umiaq Line have not been used, refunds shall             
                           be made not later than one month from the date of the outward journey.
§ 3 If field ice or any similar natural obstacle renders it unsafe to continue the journey, Arctic Umiaq Line can break off the journey at the nearest port, pending improvement in the weather/ice and suchlike with a view to then continuing the journey subject to a delay.
 Subs. 2. If ice or any similar obstacle results in Arctic Umiaq Line deciding that the passenger cannot join the trip, no claim can be made against Arctic Umiaq Line on these grounds. Arctic Umiaq Line’s transport obligation always presupposes that Arctic Umiaq Line has the capacity to take the passenger on board at the usual passenger landings and, immediately following this, to have the vessel depart on schedule. For passengers whose journey cannot be commenced, costs of hotels and so on shall be no concern of Arctic Umiaq Line’s.

§ 4 Where conveyance under the transportation agreement is effected in part or in full by a specific carrier other than Arctic Umiaq Line, Arctic Umiaq Line shall not be liable for damage, loss or delay occurring during such transportation conducted by the other carrier. The same shall apply where the passenger is entitled under the carriage agreement to be transported in part or in full by someone other than Arctic Umiaq Line.

§ 5 Where so dictated by conditions, baggage may always be kept on deck.

§ 6 Arctic Umiaq Line bears no liability for live animals conveyed as baggage.

§ 7 Arctic Umiaq Line’s liability cannot exceed 175,000 SDR for each passenger who has died or been injured.
Subs. 2. Liability for delay in conveying passengers cannot exceed 4,150 SDR.
  Subs. 3. Arctic Umiaq Line’s liability for loss as a result of baggage having been lost, damaged or delayed cannot exceed:

1) 1,800 SDR per passenger for hand baggage;
2) 6,750 SDR for money, securities and other valuables such as silver, gold, watches & clocks, gems, jewellery and works of art which Arctic Umiaq Line has been given for safekeeping. If the objects listed here have not been handed over to Arctic Umiaq Line for storage, Arctic Umiaq Line shall not incur liability for loss of or damage to these.
3) 2,700 SDR per passenger for other baggage.
4) SDR shall mean the special drawing rights used by the International Monetary Fund.

§ 8 From any loss arising, Arctic Umiaq Line can deduct:

1) 20 SDR per passenger for loss of or damage to baggage.
2) 20 SDR per passenger for loss resulting from delay.

 § 9 Arctic Umiaq Line bears no liability for the passenger for the period preceding passenger boarding and after disembarkation. However, this exemption from liability does not extend to maritime transport between vessel and land or land and vessel where the price of the ticket covers this transportation or where effected by some means of transport made available by Arctic Umiaq Line.
  Subs. 2. However, Arctic Umiaq Line is not liable for damage or injury sustained by the passenger, including loss of baggage on excursions at sea by means of transport other than the vessel on which the passenger is being transported, if these excursions are purchased separately as an add-on and are not included as part of the agreed ticket price.

 § 10 Arctic Umiaq Line bears no liability for hand luggage for the period before items are brought aboard and after they have been taken ashore. However, this exemption from liability does not cover the maritime transport between vessel and land or land and vessel if the price of the ticket covers this transport or the transport is effected by some means of transport made available by Arctic Umiaq Line.

 § 11 Arctic Umiaq Line’s duty to pay compensation is always conditional on the damage/injury/loss having been caused by an event occurring during transportation and to such damage/injury/loss being due to error or neglect shown by Arctic Umiaq Line or by some party for whom Arctic Umiaq Line is accountable.

 § 12 Complaints and reporting of any damage or injury shall be addressed to the ship’s master (the bridge) before leaving the vessel. The claim against Arctic Umiaq Line must be put forward in writing, accompanied by a report from the ship.

 § 13 Compensation claims lodged against Arctic Umiaq Line shall be statute-barred if legal action against Arctic Umiaq Line has not been instituted no later than two years after the day the passengers and/or the baggage was landed or, if such cargo has been lost, no later than two years from the day disembarkation is supposed to have taken place.

 § 14 In the event of a compensation claim being lodged against the ship’s master, an officer, member of crew, forwarding agent or anyone else for whom Arctic Umiaq Line is accountable, the party or parties in question shall be entitled to cite the same liability waivers and liability restrictions as Arctic Umiaq Line.

 § 15 Arctic Umiaq Line’s vessels are registered under the Greenland flag. The language of safety aboard is Danish.

 § 16 Carriage shall otherwise take place in accordance with Arctic Umiaq Line’s timetable and prices current from time to time and the provisions contained therein, as well as in accordance with maritime law. Nothing in these conditions of carriage is intended to extend passengers’ rights beyond what is valid in accordance with the mandatory rules to this effect in the Danish Merchant Shipping Act.

 § 17 Any claim against Arctic Umiaq Line shall be lodged with the Greenland High Court in Nuuk. There is no jurisdiction elsewhere.

As at 2009, 1 SDR is roughly equivalent to DKK 8.00 or USD 1.6.
